1. Definition
In the T&Cs, terms beginning with a capital letter have the following meaning.
Special Conditions: any special conditions mentioned on the Site in connection with a particular product(s).
Customer: any person placing an order via the Site.
Calendar Days: weekdays, including weekends and public holidays officially recognized by the cantonal legislation applicable to the Bal des Créateurs headquarters.
Working days: weekdays, excluding weekends and public holidays officially recognized by the cantonal legislation applicable to the headquarters of Le Bal des Créateurs.
Customer service: Bal des Créateurs customer service.
Other terms beginning with a capital letter have the meaning attributed to them in the Terms of Use.
2. Scope of application and modification of the GTC
The GCS govern the contractual relationship – and form an integral part of the contract – between Le Bal des Créateurs, on the one hand, and the Customer, on the other. They form an integral part of the Terms of Use, which apply in all other respects. In the event of any discrepancies between the GTC and the Terms of Use, the former shall prevail.
By placing an order or making an appointment via the Site, the Customer acknowledges having read, understood and accepted, without reservation, the General Terms and Conditions of Sale. In the event of disagreement with the GCS, the Customer shall refrain from placing an order or making an appointment via the Site.
Le Bal des Créateurs reserves the right to modify the GTC, at any time and without notice, by publishing a new version of the GTC on the Site (which cancels and replaces the existing and previous version). Any order placed or appointment made after the publication by Le Bal des Créateurs of a new version of the GCS implies acceptance of this new version.
The Special Terms and Conditions are an integral part of the General Terms and Conditions, which apply in all other respects. In the event of any discrepancy between the Special Terms and Conditions and the GTCS, the Special Terms and Conditions shall prevail.
3. Information mentioned on the Site
Although Le Bal des Créateurs strives to provide its customers with the most complete and accurate information possible, the photos, videos and texts illustrating and describing our services, as well as the stock levels mentioned on the Site, are non-contractual and are provided for information purposes only. They do not constitute an offer on the part of Le Bal des Créateurs (which does not guarantee their accuracy) and can in no way be qualified as guarantees or promised qualities.
4. Registration
The Customer is solely responsible for the accuracy and completeness of the data he/she provides when registering on the Site. If necessary, the customer must inform Bal des Créateurs of any changes to the data he or she has provided, immediately updating his or her profile.
The Customer must provide a valid e-mail address to which all communications relating to the appointment or order will be sent. It is the Customer’s responsibility to keep this address up to date and to take note of e-mails sent by Le Bal des Créateurs. The Customer shall also configure – and regularly check – his “junk mail” box to ensure that no Bal des Créateurs e-mail appears there. Any communication made to the Customer by e-mail will be considered as received by the latter on the effective date and time of receipt, but no later than 24 hours after it is sent by Le Bal des Créateurs.
5. Appointment and order process
Only Customers who have reached the age of majority, are capable of discernment and are not under guardianship may make an appointment or place an order via the Site.
To make an appointment or place an order, the Customer must follow the procedure available on the Site. All other appointment or order procedures are excluded.
By making an appointment or placing an order, the Customer binds himself and declares that he is making a firm and definitive request to Bal des Créateurs for the appointment selected, under the conditions indicated on the Site. Formally, the Customer makes an appointment (subject to the resolutory conditions set out in articles 10 to 12) from the moment Le Bal des Créateurs sends the Appointment Confirmation to the Customer. Le Bal des Créateurs reserves the right to refuse an appointment at its own discretion, without being obliged to give reasons.
The data recorded by Le Bal des Créateurs constitutes irrefutable proof that an appointment has been made. The data recorded by the payment system constitutes irrefutable proof of financial transactions.
6. Awards
Le Bal des Créateurs reserves the right to modify its prices and price lists at any time. Only the price indicated in the Appointment Confirmation is binding.
Prices shown on the Site are in Swiss francs (CHF) and include VAT and SWICO tax where applicable. They do not include any additional taxes that may be required by law.Prices shown on the Site are valid only in Switzerland and the Principality of Liechtenstein.
7. Payment
The payment methods accepted by Le Bal des Créateurs are exclusively those indicated on the Site.
All appointments are subject to the prior payment of a deposit of at least 10% of the total amount excluding VAT of the service ordered, or of the total amount including VAT of the services requested. If Le Bal des Créateurs exceptionally refuses to make an appointment, the amount paid by the Customer will be refunded (without interest). If only a deposit has been paid, Le Bal des Créateurs will inform the customer of the procedure to follow to pay the balance of the price. If, despite a reminder e-mail from Bal des Créateurs, the Customer does not pay the balance, for any reason whatsoever, Le Bal des Créateurs will be released from its obligation to provide a service and the deposit may be retained by Le Bal des Créateurs as contractual penalty.This is to settle all accounts and claims in connection with the service(s) concerned.
ATTENTION: Only cancellations made 3h00 in advance will be accepted. All bookings confirmed by sms and/or by our reception are now subject to a deposit to avoid missed or forgotten appointments. We regret this measure, which we had to take due to the large number of missed appointments, and thank you for your understanding.
Payments are made via servers provided and secured by Bal des Créateurs’ partner financial institutions, so that no financial information concerning the Customer passes through our servers.
The risk of a malfunction of the payment system is borne by the Customer, at the entire discharge of Bal des Créateurs.
9. Gift vouchers
Customers can purchase gift vouchers through the Site. These are transferable and can therefore be offered to third parties. Gift vouchers cannot be acquired by means of a discount or commercial offer granted to the Customer (e.g. a discount that would have been granted or an amount that would have been offered by Le Bal des Créateurs).
Gift vouchers have a value of CHF 10, 20, 50, 100, 200 or 500 and can be used to order products or services on the Site, supplemented if necessary with another means of payment accepted by Le Bal des Créateurs. However, they cannot be added together.
The value of a gift voucher cannot be paid out in cash and does not earn interest.
Each gift voucher is valid for two years from the date of purchase.
Gift vouchers are delivered in electronic format directly to the purchaser’s customer account. The latter is then solely responsible for access to – and the use, possible transmission and conservation of – the gift vouchers he/she has acquired. Gift vouchers will not be replaced or refunded in the event of theft, loss or damage. Bal des Créateurs accepts no liability for the use of a gift voucher by an unauthorized person.
The resale or use of gift vouchers for commercial purposes, in any form whatsoever, is prohibited. The reproduction or edition of Bal des Créateurs gift vouchers is also prohibited.
10. Summary of terms and conditions
For ease of understanding, all or part of the T&Cs may be summarized in an insert in the margin of the T&Cs. This summary does not form part of the General Terms and Conditions, which alone are binding. It is provided for information purposes only and is not contractually binding. The Customer shall not be entitled to rely thereon.

Any reproduction, distribution or other use of the General Terms and Conditions of Sale, in modified or unmodified form, is prohibited without the prior written consent of the author.
